1. About These Terms
These Terms & Conditions apply to all purchases from Authentic Gates, whether made through our online store or via a custom quote. By placing an order, you agree to these terms.
In these Terms:
(a) Seller, we, us, our means Authentic Gates and its successors or assigns.
(b) Buyer, you, your means the person or business placing the order.
(c) Goods means gates, hardware, or other products supplied by Authentic Gates.
2. Orders and Quotes
- Online store orders – Payment is taken in full at checkout. Prices include GST unless stated otherwise.
- Custom orders – We will issue a written quote covering specifications, pricing, and lead time. Your order proceeds once you accept the quote in writing and pay the required deposit. The balance is due on completion and before despatch. For very large custom projects, staged progress payments may be arranged or required, with the final balance due before despatch. All payment stages and due dates will be stated on the quote or invoice as agreed by both you and us.
3. Product Information and Material Variations
Many of our products are made from natural materials and handcrafted processes.
- Timber: Gates are generally supplied in the raw (unsealed) state unless otherwise stated. While we use seasoned timber, changes in temperature and humidity may cause minor movement, shrinkage, or expansion in some components over time. These are natural characteristics of timber and not considered defects. Variations in colour, grain, knots, gum veins, and minor surface checking are also normal.
- Steel: Steel gates are hand-welded and hand-finished. Small surface marks, weld joins, or texture variations may be visible through powder coating or painting. These are normal signs of handcrafted metalwork and not considered defects.
- Finishes: Powder coating or painting may highlight the natural texture of the material beneath. Slight colour differences between batches or components are normal.
If exact colour or finish appearance is critical, please ask us for photos, samples, or examples before ordering and we will provide these where it is practicable for us to do so.
4. Suitability for Purpose
You are responsible for choosing products that meet your intended use and site conditions. While we can provide general guidance, final selection of gate size, design, finish, and accessories is your decision.
Where practicable, you may inspect display items, sample materials, or photos of similar products before ordering. For custom or made-to-order gates, you may also request to view your gate before dispatch by prior arrangement.
Your order is based on your chosen specifications and selection from our standard range unless we have confirmed a custom variation in writing. We are not responsible if a gate or accessory does not suit your specific site, design, or automation requirements unless we have confirmed suitability in writing before you order.
Changes cannot be made once production starts unless we agree in writing.
5. Approvals and Site Conditions
You are responsible for obtaining any council or regulatory approvals that may apply to your property, including boundary, height, or heritage requirements. We do not provide planning, engineering, or legal advice.
Authentic Gates supplies products only and does not provide installation services. It is your responsibility – or that of your chosen installer – to ensure the site is suitable, measurements are correct, and installation complies with all relevant standards and regulations.
Upon request, we can provide standard specification information or drawings to assist you or your installer.
We are not liable for issues arising from site conditions, incorrect installation, or non-compliance.
6. Finishing and Maintenance
All gates are supplied unsealed unless otherwise stated. It is the Buyer’s responsibility to ensure the product is finished or maintained in accordance with its material type and intended appearance. Correct finishing and ongoing care are essential to preserve the gate and maintain warranty coverage.
Treated Pine and Joinery Gates
- All exposed treated pine or machined joinery components must be sealed and finished immediately after delivery and before installation.
- Apply at least three coats of a light-coloured, exterior-grade paint or a suitable oil-based sealer to all faces and edges, including the bottom edge. (The bottom edge may require removing the gate to access fully.)
- Gates exposed to full sun should be finished in light, reflective colours to minimise surface stress.
- Failure to properly seal or maintain pine or joinery gates may result in warping, cracking, or moisture damage and will void the warranty.
Hardwood Gates
- Hardwood gates can be either sealed with a clear or tinted exterior-grade finish to maintain colour, or left unsealed to naturally weather to a silver-grey patina.
- Natural weathering is an expected and desirable surface change and does not affect structural integrity or warranty coverage.
- Regular cleaning and inspection are recommended to maintain appearance and performance.
Steel Gates
Steel gates are supplied in a choice of two finishes:
- A natural rustique patina for an aged appearance, or
- A black zinc-rich epoxy undercoat that will naturally develop surface patina and weathering over time.
If you prefer to maintain a traditional black-iron appearance, you are responsible for applying and maintaining a suitable top coat of exterior-grade enamel paint.
Allowing the steel to weather naturally to a rusted patina is a common and desirable finish option; however, surface corrosion or colour variation from this process is not covered by warranty.
Authentic Gates is not responsible for corrosion, fading, or surface deterioration resulting from natural exposure, lack of sealing, or insufficient maintenance.
7. Variations and Availability
Any requested variations in size, design, quantity, colour, or finish by you may change the price and the lead time, if accepted by us. We will confirm any changes in writing.
We may also make reasonable product updates or substitutions where required by supply constraints after discussing options with you.
8. Delivery, Risk, and Inspection
We deliver Australia-wide using reputable freight partners. Estimated timeframes vary by location and product.
- Risk passes to you when the Goods are collected by you or your carrier, or when we hand them to our carrier for delivery to you.
- Inspection – Check your order on delivery and notify us in writing of any damage or concerns within 7 days.
- If a third-party installer is engaged, the Goods should be inspected and approved before installation begins.
We are not liable for damage caused by handling, storage, or installation by you or third parties.
9. Payment and Ownership
Payment terms are outlined in Section 2 (Orders and Quotes).
All payments must be made as specified on your quote, invoice, or checkout record. Manufacture and despatch will not commence until the required payment has been received and cleared in full.
Because each made-to-order product is manufactured specifically for the Buyer, payments for those products are non-refundable once manufacture has started, except where required by law.
Ownership – Ownership of all Goods remains with Authentic Gates until they are collected or delivered to the Buyer or the Buyer’s nominated carrier.
10. Cancellations and Returns
Custom-Made Orders
All Authentic Gates products are made to order unless otherwise stated. Once an order is confirmed and payment has been received, materials and production scheduling begin immediately.
- Orders accepted by Authentic Gates cannot be cancelled, deferred, or changed without our written consent.
- If we agree to a cancellation before manufacture begins, you must reimburse Authentic Gates for all costs and losses incurred. In every case, a cancellation fee of not less than 30% of the total order value or our actual costs (whichever is higher) will apply.
- Once manufacture has started, orders cannot be cancelled.
- Custom-made products are not returnable or refundable except where required by Australian Consumer Law.
Floorstock and Limited Release Items
From time to time, we may offer pre-made floorstock, display, or limited-release gates for sale.
- These products may have minor variations or marks from display or handling, which are clearly noted at the time of sale.
- Floorstock and limited-release items are sold as-is, with any specific warranty terms stated on the product listing or invoice.
- Returns or exchanges are not accepted unless required under the Australian Consumer Law.
- If a return is approved under ACL, the product must be in the same condition as supplied, with all freight costs prepaid.
Your rights under the Australian Consumer Law (ACL) are preserved.
11. Warranty
We stand behind our workmanship.
- Hardwood gates – Full 10-year warranty.
- Metal gates – 10-year structural warranty (surface coatings and finishes are not covered).
- Floorstock and limited releases – Warranty may differ and will be clearly stated in the product description.
This warranty covers defects in materials and workmanship under normal use. It does not cover natural timber variation, improper finishing or maintenance, incorrect installation, weathering, misuse, or alteration. Warp or twist is not considered a defect unless the deviation exceeds 2.5 percent of the longest dimension of the affected component.
Conditions and process
- Correct sealing and maintenance per Section 6 are conditions of warranty.
- Claims must be submitted in writing with proof of purchase and clear photos.
- Removal and reinstallation are not covered. You are responsible for shipping the product to us for assessment. If a warranty defect is confirmed, we will repair or replace the product or cover reasonable return shipping costs at our discretion.
Your rights under the Australian Consumer Law (ACL) are not affected.
12. Limitation of Liability
To the extent permitted by law, our liability is limited to repair or replacement of the Goods or the cost of doing so. We are not liable for indirect or consequential loss, including installation, labour, or transport costs.
13. Events Beyond Our Control
If we are unable to continue or complete the manufacture or delivery of Goods due to any cause beyond our reasonable control – including supplier delays, transport disruptions, extreme weather, or industrial action – our obligations will be suspended while that cause exists. We will be entitled to a reasonable extension of time to complete the manufacture or delivery once the cause has been resolved.
14. Cancellation
Orders accepted by the Seller cannot be countermanded, delivery deferred or returned except with the written consent of the Seller and upon terms that reimburse and indemnify the Seller against all losses incurred in such cancellation. In every case, the cancellation fee shall not be less than 30% of the total contract value of the goods.
Standard items may be returned for credit or exchange only with the consent of the Seller and in new condition with all freight charges prepaid and will involve a restocking charge of 30% of the total contract value of the Goods.
15. No Oral Representations
Only the specifications in our quote, order confirmation, website, or written communications form part of your order. No dealer, installer, or other person is authorised to make promises or representations that conflict with our published materials. If something is important, ensure it is written into your quote or order confirmation.
16. Governing Law and Severability
These Terms are governed by the laws of New South Wales, Australia. If any provision is invalid or unenforceable, it is severed and the remaining provisions continue in full force.
17. Updates
We may update these Terms from time to time.
